Dr. Tunji Braithwaite, lawyer and former presidential candidate of Nigeria Advance Party, NAP, has accused Standard Chartered Bank Plc, of illegally procuring a permit to construct a 14-storey building at 142, Ahmadu Bello Way, Victoria Island, Lagos.
In a suit filed by Rasaq Okesiji Chambers on his behalf at Federal High Court presided over by Justice Doris Okuwobi, Braithwaite, among other things, is claiming N10 billion as damages in respect of the construction of the 14-floor building and a five-level car park on the land, saying it was unlawful and an infringement on his right.
He is also asking the court to declare that the commercial building now at 14th floor constitutes an illegal structure.
Braithwaite further alleged in his evidence that Standard Chartered Bank deliberately flouted a Federal Court of Appeal ruling, which stopped further construction of the bank building pending the determination of a suit before it.
He informed Justice Okuwobi that the bank had tampered with Court of Appeal’s injunction restraining Standard Chartered Bank from further construction of the building and went ahead to construct the commercial building up to the 14th floor.
He said the permit Standard Chartered Bank relied upon was illegally procured while the Lagos State Government approved the permit wrongly, negating the Federal Ministry of Environment’s impact assessment.
In his response, Mr. Adeniyi Adegbonmire, lawyer to Standard Chartered Bank, denied all the allegations and explained to Justice Doris Okuwobi that the said permit was genuinely issued by the Lagos State Government and denied any court order stopping further construction of the building.
Justice Okuwobi adjourned further hearing in the suit till 28 and 30 October, 2014.
