The 36 states of the federation have sued the Federal Government at the Supreme Court over alleged illegal deductions from source by the Nigerian National Petroleum Corporation (NNPC) of monies that ought to go into the Federation Account.
The suit filed by the Attorney General of Abia State and 35 other AGs against the FG is contending that any deduction from source under the guise of fuel subsidy was illegal and unconstitutional as the monies ordinarily ought to go first into the federation accounts before any such deductions.
Under the present fuel subsidy scheme, the NNPC deducts from source before monies are remitted into the federation accounts contrary to Section 162 of the Constitution.
When the matter came up for hearing Tuesday, the presiding judge, Justice Mahmud Muhammed adjourned the case till December 8 for trial.
Other justices on the panel are Muntaka Coomasie, Sylvester Ngwuta, Rhodes Bode Vivour, Bata Clara Ogunbiyi, Inyang Okoro and Kudirate Kekere Ekun.
Former President of the Nigerian Bar Association (NBA), Joseph Daudu SAN and Hakeem Fagbemi SAN announced appearance for the state governors while Taiwo Abidogun, an Acting director, Civil litigation, Federal ministry of Justice represented the Federal government.
